“A European regime for the pledging of securities and the assignment of receivables”

In October 2021, the Haut Comité Juridique de la Place Financière de Paris (HCJP) presented a report on the pledging of financial securities in the European Union (https://www.banquefrance.fr/sites/default/files /report_43_e.pdf).

The report proposed the enactment of an instrument of European Union law on the 28th regime for the pledging of financial securities intended to compensate for the lack of harmonization of the law on the pledging of financial securities by European
Union law. . The idea was to add to the 27 national regimes a supplementary regime facilitating cross-border pledging.

A year and a half after the reform of securities law in France, the opportunity can be taken to reconsider the advisability of a European regime for the pledging of financial securities and the assignment of claims, from a Franco-German perspective., by articulating the reflection with the work of the Association Henri Capitant on a European business code.
