“Presentation of the HCJP report on the extraterritoriality of European Union law”.

The High Legal Committee of the Paris Financial Center has just published a report on the extraterritoriality of European Union law, the result of the work of a group of specialists and practitioners chaired by Francesco Martucci, Professor at the University of Paris-Panthéon-Assas, and Pierre Minor, lawyer, former General Counsel of the Crédit Agricole Group.

In 2021, the European Commission published a communication intended “to strengthen the role of the European Union on the world stage”. While this idea is eminently political in nature, it also raises legal issues, including the problem of extraterritoriality, which is defined as “the characteristic of legislative or regulatory measures and administrative or jurisdictional decisions that are intended to apply beyond the territory of a sovereign State, and without a sufficient link to that country.

The HCJP questioned the extent to which the provisions of European law can apply and produce effects with respect to persons, goods or services located outside the territory of the Member States of the European Union. The report concludes with five avenues for legal reflection that are considered essential to ensure the effectiveness of any extraterritorial measures decided by the Union.
