“The reform of the law of securities by the ordinance n° 2021-1192 of September 15, 2021: selected aspects”

The ordinance of September 15, 2021 has three objectives

1. to complete the 2006 reform by renovating the law of surety ;
2. to respond to the various difficulties encountered in practice in the handling of security interests
3. to complete the list of security interests.

These three aspects will be explored, with an emphasis on what is of particular interest to banks, according to the following plan:

I. A renewed surety bond
II. Improved security interests in financial assets
III. New property security interests enshrined.
