“What future for the CJIP and compliance in Europe: towards the development of a European model of negotiated justice? “

The law of 9 December 2016 on transparency, the fight against corruption and the modernisation of economic life, known as the “Sapin 2 law”, created a unique negotiated criminal justice mechanism in France.

This system combines the public interest judicial agreement (CJIP) proposed by the public prosecutor to companies prosecuted for corruption, tax fraud and laundering of these offences and the monitoring by the French Anti-Corruption Agency of the obligations to comply with anti-corruption standards that are imposed on them either within the framework of the CJIP or outside any pre-existing criminal proceedings.

Four years after its entry into force, not only is anti-corruption and fraud law becoming more global under the impetus of the US authorities and the OECD, but it is also becoming more regional with the entry into force of the European Public Prosecutor’s Office in June 2021. The time has therefore come to take stock of the situation and to outline the prospects for deployment of the system within the European Union.
